That is when George Mason got involved. Mason was an attorney who had an office in the same building where Feavers firm had its offices. Mason becomes the voice of the novel as Feavers attorney for the defense of the tax fraud charges. The story is told largely from his point of view as he attempts to help Feaver through what becomes a complicated hodgepodge of personal relationships, schemes, double-dealing, subterfuge and, ultimately, death. It seems the U.S. Attorney is interested in leveraging the potential tax charges against Feaver to force Feavers cooperation in a sting operation. The target of the sting is Feavers law partners uncle, the chief judge of the local court. U.S. Attorney Sennett believes there is widespread corruption in the courts. Feaver confirms that he has been involved in a system by which he can influence the outcome of cases favorably. The system involves giving money to various people who work for different judges, and the belief is that some of the money in each case makes its way to the chief judge.
Taxation of Personal Injury Awards Recent legislation, as part of the Revenue Reconciliation Act of 1989, may have settled some of the other areas of disagreement. The legislation provides that the exclusion for personal injury awards does not apply to any punitive damages in connection with a case not involving physical injury or physical sickness.(1) Thus, it would appear that all damages, both compensatory and punitive received for physical injuries will be excluded from gross income. Only compensatory damages received for non-physical injuries will be excludable from gross income. Punitive damages received for non-physical injuries will be taxable. The new provision is effective for amounts received after July 10, 1989, in tax years ending after that date, unless a binding agreement, decree or award is in effect before then. Despite the clarifying legislation, areas for disagreement between taxpayers and the IRS still exist regarding the nature of non-physical injury awards involving libel or defamation of character. The dispute arose last fall after JTL Group applied for a state reclamation permit for a 33-acre pit east of Kalispell on property that is zoned SAG-5 suburban agricultural. The battle of the video-game consoles will reach new intensity this week when Sony gives the first full public demonstration of its new-generation PlayStation 3 at the Electronic Entertainment Expo in Los Angeles. At the same exhibition, Nintendo will unveil its latest model, the Wii. It remains to be seen if the much-anticipated new PlayStation turns out to be further cause for celebration for Sony, which has dominated the market since the first PlayStation came out in the late 1990s. Sony dominated the previous generation of consoles. PlayStation 2 accounted for 64 per cent of the US market, with Microsoft a distant second with 16 per cent. Now, some analysts are predicting Microsoft could gobble up almost half of the market, with Sony dropping down to one third. It probably does not help that PS3 is expected to retail for about$499 (pounds 250) in the US, $100 more than the new- generation Xbox.

The coalition is being created to lobby Congress to increase the current level of federal funding for national disability recreation and sports programs (RSC, 2001, p 6). We are now in our second year of providing chiropractic coverage to the ED. In November 2000, Meadowlands Hospital Medical Center in Secaucus, New Jersey began offering chiropractic care in the ED. In an effort to satisfy the Joint Commission on Hospital Accreditations mandate to better address pain management, Meadowlands ED Director Gina Puglisi,MD, and Albert Cataffi,DC, former chiropractic department chief, developed and instituted a “chiropractor on-call” program. Dr. Puglisi readied the chiropractors with an orientation program to define the roles of the chiropractors and the rest of the ED in treating neck and back pain patients. Patients who present to the ED with neck or back pain are screened by the attending ED physician, who is responsible for ruling out serious pathology, fracture, neurological deficit, and other findings that might contraindicate spinal manipulation. The ED physician may order x-rays, blood work or other diagnostic tests. When a severe condition presents, orthopedists, neurologists or neurosurgeons are enlisted to take over the case. Historically, all patients without serious pathology were given prescriptions and discharged from the hospital, with or without adequate relief. With our chiropractor-on-call program, the ED physician now has the option of calling for a chiropractic consultation, which gives the patient the opportunity to receive additional relief.

The Commerce Department reported Tuesday that builders started construction on new homes and apartments at a seasonally adjusted annual rate of 1.84 million units in March, down from 2.23 million units in February. Analysts had been expecting a decline in housing, but the steepness of the drop, the biggest plunge since January 1991, caught them by surprise. “This is a bit of a shocker,” said David Seiders, chief economist for the National Association of Home Builders. “But I dont think this represents a fundamental downshift in the housing market. The literature on sound recording is as old as the technology itself. Yet despite the enormous variety of writings on the subject since the late nineteenth century, one assumption underlies most of the literature–that recording simply records. Only recently have scholars begun to question that assumption, exploring the possibility that recording has in fact had a profound influence on the musical world it documents. Timothy Day, a curator at the National Sound Archive in London, offers the latest contribution to this new scholarship. As he states from the outset of A Century of Recorded Music, recording has changed the way we listen to music and the way music is performed (p. ix). The scope of the book is somewhat narrower than the title suggests, as Day focuses on the creation and reception of recorded classical music in Britain and, to a lesser extent, the United States. This is a not a weakness of the book (just of the title), for the authors circumscription allows him to illustrate particular histori cal points in considerable detail in order to suggest the rich possibilities that the study of recordings offers (p. x). Day proceeds to do exactly this in the books four chapters. For the bulk of chapter 1, Making Recordings, Day considers the recording process from the view of the performer, explaining the changing demands of the technology and documenting performers experiences with, anti attitudes toward, recording. Among many crucial points Day drives home is that for decades, the process of making recordings was shaped by technical shortcomings (p. 24), whether due to the insensitivity of acoustic recording horns, the distortions wrought by early microphones, or the tape hiss of magnetic recording. Performers (as well as engineers and producers) had to compensate for these limitations, shaping the way music was performed in the studio and, consequently, heard by listeners. While otherwise compelling here, Day repeats a common and unsubstantiated claim–that in the 78-rpm era performers had to modify speeds [i.e., play faster] because of the time limitation of the. disc (p. 33). But rather than rushing through a piece, recording musicians were more inclined to accommodat e the time limitation by cutting music. Indeed, when listening to 78s, one can hear many leisurely performances of drastically Cut pieces. Later in the chapter (pp. 34- 46), Day shifts his focus from performers to producers, profiling such influential figures as Fred Gaisberg, Walter Legge, and John Culshaw. Here, Day rightly emphasizes how those on the other side of the microphones have shaped the way we hear music to an extent that few appreciate. The second chapter, The Repertory Recorded, chronicles the enormous expansion in the amount of classical music recorded over the course of the twentieth century. Day focuses on the impact of important record releases–from the National Gramophonic Society, in HMVs History of Music in Sound series, on Deutsche Grammophons Archiv Produktion label, and many, many others. Days thoroughness, however, becomes a liability with page after page of lists: of the contents of various anthologies, of the classical works broadcast by the BBC, of the discs reviewed in selected issues of Gramophone, and so on. While the authors encyclopedic knowledge is impressive, the sheer amount of raw data may well discourage readers. Perhaps Day intended these lists to be consulted rather than read straight through; nevertheless, there is often a lack of accompanying synthesis and perspective. For example, at several points in the chapter (pp. 58, 76, 128), Day makes or cites the claim that recording led to a mass audience for cla ssical music in Britain. The implication is that the expanded audience was a function of the increased production of classical recordings, such as those he surveys in the chapter. But did the proportion of classical music lovers in Britain actually change? Perhaps existing classical music devotees simply listened to more recordings once they became available, or perhaps the increase in Britains population matched or exceeded the growth of the classical record industry. Day restates his claim in the last chapter, citing as evidence the hundreds of thousands of issues of Gramophone and similar magazines sold in Britain in 1994 (p. 200). While this may be a large number, does it really reveal a mass audience in a nation of more than fifty million? An explicit discussion of terms–he does not define mass audience–and a more rigorous analysis of possible cause-and-effect relationships here would have been welcome.

If youve a mind to show off, then you do so in the best of company with Bartoks Concerto for Orchestra. Characteristically, though, Gattis Bartok is more about drama than display. And thats more of a novelty than you might think. Bartok so often gets left behind in performances of the Concerto. So often its about sound not because of sound. So often the music is subsumed by the special effects. The shows the thing. Not here. Gattis “Introduzione” at once opens magic casements on to the concerto beyond. Muted string tremolandi are drawn like a veil over the opening pages, the violas sul ponticello adding a touch of frost. The solo flute is pale and very interesting. Not a bar, not a note goes by that doesnt convey something. The intrigue of a first encounter, thats the spirit. So those little oboe and/or clarinet and harp diversions in the first movement come on like ancient airs and dances; so there is nothing remotely faceless about the woodwind “couplets” of the second movement; so the third movement “Elegia” stretches and intensifies the dynamic possibilities, suggesting a lake of tears to shame even Bluebeard, with ardent violins pulling more sound up from their bottom strings than Ill wager even they thought they had. When did you last hear the cor anglaiss plangent canon to the lyric main theme of the “Intermezzo interotto” sound this purposeful? And since when did Till Eulenspiegel get to play tag with the Shostakovich “Leningrad” theme? All right, so the finale sacrifices fire to the rustico character of the music (presto? hardly), so youre listening to the Royal Philharmonic thinking of the Chicago Symphony. But theres more music being made here than in the average Concerto for Orchestra - and thats a fact. The Divertimento, meanwhile, is further testament to Gattis work in progress with the RPO strings. Folk dance and fiddling are at the heart of this piece, the character once again dictating the sound. Which is just as it should be and so rarely is. Edward Seckerson

If there is one subject easy to find people to talk to about, you would think it would be retirement. But when researchers recently contacted several hundred people on a list of those considering buying a retirement home, the vast majority of them were either travelling, or busy juggling full schedules. Couples often want to get rid of the large family house, but dont like to think that the next move they make will be the last. They want independence, but with the fall-back of a warden on site in an emergency. In 1982, there were only 2,500 private sheltered units in existence in the UK. Today, that figure stands at 90,000, and since the over-55s account for two-fifths of the countrys wealth, they are proving to be a demanding market. It is no longer possible, as it was in the Eighties, for developers to produce small, box-like homes for the elderly and expect them to sell. Now, the key is space and the more American notion of “service”. All the problems and practicalities of running a home can be passed on to someone else - albeit at a price. Increasingly, the service offered to people buying in the grounds of a nursing home is becoming more popular and widespread. “Close care” is similar to sheltered housing, but with the bonus of nursing care either at home or in the main house. Its greatest appeal is that the elderly stand a good chance of staying in their own homes for the rest of their lives. Gwyneth Hodgson, now 84, moved into her flat in the grounds of Hays House, near Shaftesbury, Dorset, when she began to find the upkeep of her house and garden too much. “I didnt want to be a burden on my son, nor did I want to bother friends. When I cut my leg one day, I pressed a button and a nurse arrived at once. I wanted to stay in the area, and this is the perfect answer. I have my dog with me, which is important because I could never live without an animal, and some places dont allow them.” Many people, unused to living so closely with others, regard the prospect with some trepidation, and Mrs Hodgson admits that she likes being alone. “I look out over fields. If it were practical, I would live in a remote country spot, but this is a fair compromise. Most of us are widows and we dont mix a great deal. But there is a residents restaurant if we do want to have lunch together or entertain.” Mrs Hodgson bought her flat from Park Healthcare on a 125-year lease. The annual service charge is pounds 2,657, but this does not cover nursing care. The company is currently selling its latest development, set in the grounds of Elliscombe House, near Wincanton, Somerset. The unusually spacious eight two-bedroom apartments and two three-bedroom gatehouses are for sale from pounds 169,500 to pounds 189,500, with an additional service charge of pounds 2,800. Service charges are the area most buyers are warned to check out thoroughly. Some offer a minimum of maintenance and warden cover, while others will reflect a ritzy hierarchy of reception staff and services that people may well not use. The cost of running a swimming pool, for instance, may not be justified for an underused facility. In its research, English Courtyard found that buyers felt some developers did not always disclose the full extent of service charge, and worried about the escalation of such costs. Calls to Help the Aged on the subject were an important factor in the charity setting up its own Property Services, a commercial arm of the main campaigning body that was created a year ago. The charity now has 6,000 buyers registered with it, and a nationwide list of retirement homes. Among any group of buyers in this sector, there will always be a “reluctant” proportion - those who will mentally tough it out, even as they become physically more fragile. Godfrey Winterson, of Hamptons International, had to work hard to persuade his mother to give up the struggle of living alone. “After a fourth fall, she started going downhill rapidly. She would not have lasted six months on her own. Now, she goes out at least three times a week and likes to have friends to stay. “The other options we considered were nursing care of pounds 750 a week, or an establishment where she was going to be cared for 24 hours a day at a cost of pounds 3,000 a month. How many years can people afford that?” asks Winterson. A flat with a warden outside a main centre, on the othe hand, could be bought for pounds 60,000, which might leave money over for supply nurses or other forms of care. Even the thought of moving is daunting for some. McCarthy Stone, the largest developer of retirement properties in Britain, finds that a third of its buyers use the part-exchange scheme, often for the convenience of not hav- ing potential buyers traipsing around their homes. The company has also noticed the growing popularity of city-centre locations where everything is on tap. In Bath, it has seen a record number of enquiries for its canalside development. Close care is not easy to find in cities but, for example, the Kensington office of John D Wood has a two-bedroom apartment for sale, for pounds 250,000, at Chartwell House, which has a nursing home attached and is one of a number owned by the Goldsborough Estates, part of Bupa. The service charges start at pounds 117.79 a week. In Richmond, Surrey, meanwhile, Bovis Retirement homes has just completed Fullerton Court, described as “very sheltered living”, where service charges are pounds 4,550 a year. There is some comfort to be taken from the resale values of good retirement properties. English Courtyard says it has beaten the nationwide indices over the past 10 years, and the property has had an annual increase of 5.69 per cent. As the population ages, this is one sector where growth must surely be guaranteed. In 1946 he joined the Medical Research Council as a publications officer, remaining until 1950 when he was appointed assistant editor of the BMJ. During the first three years with the MRC he edited the councils annual reports, assisting also in the preparation of Medical Research in War–the MRCs report for 1939-45. When he joined the BMJ it was at once apparent that Martins training in administration at the MRC would be an asset to an office that was rather apt to rely on the inspiration of the moment to the detriment of a more continuous orderliness. He introduced systems to make the previously ill organised knowledge and experience of the staff more readily accessible, and despite occasional symptoms of reluctance to use these arrangements they were generally welcomed. As assistant and later deputy editor Martin organised the publication of several series of refresher courses, ran the Any Questions? section, and was responsible for that section of the journal notorious for its pitfalls, the correspondence. To all these tasks he brought a thorough grasp of detail and an understanding of what the reader requires from the expert. At the beginning of 1966 he succeeded Hugh Clegg as editor and soon showed that he was offering a striking contrast to the previous regime. Clegg had been an autocratic leader and a fluent, stimulating writer. Martin took the role, to use his own words, of committee chairman rather than general of an army. The new policy had the great merit of enabling every member of the staff to make, and to feel that he was making, a more direct contribution to the editing of the journal. Another innovation of benefit to the journal was his encouragement of members of the staff to travel abroad, both to represent the journals interests in foreign countries and, perhaps more to the point, to learn at first hand about their medical practice, personalities, institutions, and politics. As a result the journal gained a broader basis from which to comment on the activities of a profession particularly noted for its international connections.

Take the broad bean. Once it was thought entirely unremarkable to produce broad beans. Most people didnt really like them, but that was because most people left on the bitter outer skin. Carefully and laboriously peeled, broad beans are really delicious and can be cooked in all kinds of ways. The only social problem with the broad bean, in those innocent days, was that the obvious effort which went into preparing it could be felt by the guest to be somewhat oppressive - a combination of showing off and bullying. Fortunately, though, most guests are more interested in themselves than in the labours of the cook, and so most people didnt mind. Then, suddenly, the broad bean became fashionable. Sadly, I had to abandon it and wait until the fashion passed, as indeed it did. But now, to my horror, I find it is in fashion once again. At least I assume it is, because we were recently given delicious broad beans on toast as a first course in the house of the most achingly fashionable couple I know. This time Im not going to give in; however chic it may be, Im going to carry on cooking broad beans, especially at this time of year. To me they mean early summer, just as much as Jersey potatoes and mint. They are not only delicious, with their bitter, subtle taste; they also look beautiful in their satisfactory roundness faintly reminiscent, I used to think as a schoolgirl, of the curving buttocks of the naked Greek athletes portrayed in my classical history textbooks. The intense green is beautiful too, especially if, like me, you use frozen beans. It cannot be denied that peeling broad beans, though easy, is very time-consuming. The busy cook cannot possibly do it. There are some Middle Eastern food shops or supermarkets which sell broad beans ready peeled and frozen. Otherwise it is a question of delegation. Children can be very useful: their small, clever fingers are ideally suited to the work. Unfortunately, though, children are a terrible health hazard in the kitchen. They have no interest in even the most elementary hygiene and one has no idea where those clever fingers have been; I always reject any offering of food cooked by children and handled by filthy childish hands. Still, under close supervision - children prone to worms should be avoided older children can be very useful. They should spread the frozen beans on a large flat tray to thaw, before starting.

That meant that cosmetic surgeons in the state could not use the phrase board-certified in advertising, and that they had difficulty getting hospital privileges, according to the American Academy of Cosmetic Surgery. A COSMETIC surgeon who was struck off the medical register more than a decade ago and later reinstated appeared for a second time before the General Medical Council yesterday charged with botched treatment of five patients that left them disfigured and in pain. One woman, Mrs B, who sought treatment for swollen eyes and lines round her mouth, paid pounds 2,500 and was left with a face described as a “huge, weeping swollen crust”. A man who sought removal of a tattoo on his arm was left with blistered skin which was “extremely painful” and described by a dermatologist as having been “overcooked”. The Egypt-born consultant was one of a number of doctors who was accused last year of promising to make Asians and black people look “white”. Dr Abu-Mahfouz was alleged to have told a black undercover reporter: “I can make you white like me. I can make you look like the English.”
